Heres a wake-up call to conservatives: Unless you change something fast,
your response to the Affordable Care Act will go down in history as a
series of tactical errors that created a gigantic government mandate while
simultaneously betraying your own principles.

.

The Supreme Courts resounding 6-3 rejection of King v. Burwell a
challenge to Obamacare that was based entirely on an overly fussy reading
of a six-word phrase is a loss for the GOP. It is a win for big business,
the GOPs traditional ally, with stocks for hospital chains like HCA and
Tenet getting a nice boost. And it is symbolic of the way that the right
has forced itself into a polarizing argument about the ACA instead of
keeping its eye on its overall goals.

Congress passed the Affordable Care Act to improve health insurance
markets, not to destroy them, Chief Justice John Roberts wrote in the
majority decision. Republicans need to step up and do the same.

.

Obamacare is shoddily written, but 11.7 million people are enrolled in its
exchanges (some will not continue coverage for the full calendar year) and
10.8 million have enrolled in Medicaid and CHP, the governments programs
for the poor, since 2013. And the law has actually worked as a catalyst to
encourage free market solutions to our broken health care system. If such
solutions arent found, were going to end up in the same position as most
other modern countries: with nationalized, single-payer health systems.

Republicans in Congress are moving toward a plan to use a special
budgetary process to repeal ObamaCare, after the Supreme Court ruled for a
second time to uphold the controversial law.

.

Since last years elections, Senate Majority Leader Mitch McConnell (R-Ky.)
has proposed using budget reconciliation to repeal large chunks of the
law.

.

The procedure would allow Republicans to pass a repeal package through the
upper chamber with a simple majority vote, bypassing the 60-vote threshold
usually required for major bills. The gambit is less relevant in the
House, where the GOP holds a sizable majority and the minority party has
fewer rights.

.

McConnell is expected to follow through on his earlier proposals, to the
delight of conservatives, after Thursdays 6-3 court ruling in support of a
provision of the healthcare law dealing with insurance exchanges and
subsidies.

.

He views the budgetary tactic as the only way to get an ObamaCare repeal
to the presidents desk.

.

The effort has no real chance of becoming law Obama is certain to veto it
but it will enable Republicans to satisfy their base supporters and draw a
contrast between the parties ahead of next years presidential election.

.

We know the presidents not likely to sign anything we send him, and the
Democrats are not likely to vote for anything we send him, McConnell told
The New York Times in an interview Thursday.

.

So it leaves only one vehicle available, if you want to revisit Obamacare,
and that would be to use reconciliation. But no decision has been made on
the timing of that, he said.

.

Speaker John Boehner (R-Ohio) also said Thursday that no decision had yet
been made in his chamber.

.

Talk among Republicans about repealing ObamaCare had slackened in recent
weeks as senators focused instead on coming up with a response to any
scenario in which the court struck down subsidies for roughly 6.4 million
people in more than 30 states.

A cat appointed stationmaster of a struggling Japanese railway has been mourned
by railworkers at its funeral and elevated to the status of “honourable eternal
stationmaster”.

Tama, who died of heart failure earlier this month, was well-known among staff
and visitors at the Kishi station in western Japan.

.

The calico cat joined the staff of the local Kishigawa railway line in 2007
when she was appointed stationmaster and given a custom-made stationmaster’s
cap and a jacket.

Her fame brought in large numbers of tourists to the station, giving a boost to
the the Kishigawa railway line which had been close to bankruptcy, as well as
the local economy.

Tama’s death was marked in a Shinto-style funeral on Sunday.

The calico cat was appointed stationmaster at the Kishi station in western
Japan in 2007. Donning her custom-made stationmasters cap, Tama quietly sat at
the ticket gate welcoming and seeing off passengers. The cat quickly attracted
tourists and became world-famous, contributing to the railway company and local
economy.

Tama, who had turned 16 in April, died of a heart failure on June 22. During
Sundays Shinto-style funeral at the station where she served, Tama became a
goddess. The Shinto religion, indigenous to Japan and practiced by many
Japanese, has a variety of gods including animals.

.

In one of several portraits decorating the altar, Tama posed in a
stationmasters hat and a dark blue cape. Sake, as well as watermelon, apples,
cabbage and other fruits and vegetables were presented to the cat. A stand
outside the station was heaped with bouquets, canned tuna and other gifts left
by thousands of Tama fans who came to pray from around the country.

Wakayama Electric Railway President Mitsunobu Kojima thanked the cat for her
achievement, and said Tama will be enshrined at a nearby cat shrine next month.

Before Tamas arrival, the local Kishigawa Line was near-bankrupt; and the
station was unmanned as it had lost its last staff.

.

Kojima said appointing Tama as stationmaster was initially an excuse to keep
the cat at the station.

.

But she was really doing her job, he said. The rest was a miracle, and his
companys success story also gave hope for dozens of other struggling tiny local
train lines, he said.

KINOKAWA, Wakayama Prefecture–Feline stationmaster Tama celebrated her 16th
birthday at Kishi Station surrounded by about 300 fans from across the country
and abroad.

Tama, whose age is equivalent to 80 in human years, also serves as acting
president of Wakayama Electric Railway Co., operator of the Kishigawa Line.

Thanks to Tama-chan, the Kishigawa Line became known not only in Japan but also
in the world, Mitsunobu Kojima, president of the company, said at the calico
cats birthday celebration on April 29. I believe she will live to 20 in cat
years and 100 in human years.

.

Among the guests were Azumi Konishi, a fifth-grader at Kinokawa citys
Naka-Kishi Elementary School, and her sister, Kokona, a second-grader at the
school. They stop by to see the stationmaster after school every day.

She is so cute when she lies down and rolls on her back, Azumi, 10, said. I
want her to stay healthy for a long time.

Tortoiseshell-coloured cat Tama, better known as the Japanese railway
tourist favourite, has passed away.

For almost a decade she has served as nominal stationmaster on an obscure
Japanese train branchline, where she brought in thousands of tourists and
even spurred a merchandising rush.

Credited by many with saving the provincial Kishigawa Line, the calico cat

human employee was laid off in April 2006.

fame, and even a bit of fortune, with ABC News’ 2007 study estimating that
Tama’s presence had injected an additional 1.1 billion yen (or about

Lawmakers and railway regulators in the Obama administration spent hours
Wednesday trading blame for the likelihood that most of nation’s railways
will miss a December deadline to automate passenger and freight trains.

.

Railroads currently have until Dec. 31 to install the positive train
control (PTC) system, which regulates the speed and track movements of
trains, under a law passed in the aftermath of a 2008 commuter rail crash
in California.

.

Lawmakers had moved to push back the deadline earlier this year before a
deadly crash on Amtrak in May revived debate about the mandate.

.

Lawmakers on the House Transportation and Infrastructure Committee in both
parties questioned Wednesday whether the Obama administration has done
enough to help rail companies meet the deadline and how they will enforce
penalties for missing it.

.

“The industry itself has spent over $5 billion on positive train control
and I don’t think that the administration have done all they need to do
to move us forward,” said Rep. Corrine Brown (D-Fla.), whose district is
home to freight rail company CSX.

.

“And to sit here and say that we are going to to have daily fines and we
may have to shut down the industry,” she continued. “It’s not going to
fly.”

Feinberg defended the Obama administration’s efforts to help rail
companies meet the deadline and said she is not in favor of pushing back
the deadline because it is ensconced in federal law.

.

“I can only speak for this administration; I can’t speak for previous
administrations,” she responded to Brown. “But this administration has
done a great deal to try to bring railroads along and into compliance with
a mandate that was passed by the Congress in 2008, and we have been
sounding the alarm for years about our concern that railroads were not
going to meet the deadline.”

.

Feinberg said she is simply following a law that was passed by lawmakers,
even as they flooded her with complaints about its impact.

WASHINGTON Railroads may have found a new weapon in their fight to keep
information about oil train shipments from the public: a federal rule that
was supposed to increase transparency.

.

The U.S. Department of Transportation insists that its May 1 final rule on
oil trains, which mostly addresses an outdated tank car design, does not
support the railroads position, nor was it intended to leave anyone in the
dark.

.

But in recent court filings in Maryland, two major oil haulers have cited
the departments new rule to justify their argument that no one except
emergency responders should know what routes the trains use or how many
travel through each state during a given week.

The departments rule was expected to expand the existing disclosure
requirements. In its 395-page rule, the department acknowledged an
overwhelming volume of public comments supporting more transparency. But
ultimately, it offered the opposite.

The final rule ends the existing disclosure requirements next March.
Railroads no longer would be required to provide information to the
states, leaving emergency responders to request details about oil train
shipments on their own, and the public would be shut out entirely.

The switch floored those who submitted comments in favor of increased
transparency.

Facing push-back from Capitol Hill, Transportation Secretary Anthony Foxx
assured lawmakers in a May 28 letter that we fully support the public
disclosure of this information to the extent allowed by applicable state,
local and tribal laws.

.

Foxx added that the department was not attempting to undermine
transparency.

.

That was certainly not the intent of the rule, he wrote eight Senate
Democrats.

.

But Foxxs assurances differ sharply from the assertions of Norfolk
Southern and CSX in court documents filed last month in Maryland. The
documents are related to a case last summer when the railroads sued the
state to block the release of oil train reports to McClatchy.

.

The final rule provides clear and unequivocal guidance that information
about oil train routes and volumes are security- and
commercially-sensitive, attorneys for the railroads wrote on May 5 to
Judge Lawrence Fletcher-Hill of the Circuit Court for Baltimore City.

The city of San Francisco will pay $11 million to a woman struck and
severely injured by a Muni light-rail train while crossing a street in
2013.

.

An Iraq War veteran, Brynn K. Stoll, was crossing the intersection of 19th
Avenue and Junipero Serra Boulevard when a Muni M-line train hit her in
February 2013. At the time, Stoll was on her way to City College from her
home in Parkmerced.

.

The accident left Stoll, now 28, in a coma for five weeks. She underwent
multiple surgeries and nearly a year of physical therapy before regaining
the ability to walk. The injuries also left her with a severe brain injury
and in need of attendant care for the rest of her life.

.

Stolls lawsuit against the city alleged she was crossing the street on a
white walk signal and that the train operator ran a red light. The lawsuit
also said the city should have known the intersection was dangerous
because a similar accident occurred a year and a half earlier, and that
the intersection had the highest number of light-rail vehicle collisions
in the Muni system.

After a City Attorney’s office assessment determined that San Francisco
had little to no chance of winning a court case against a woman who was
permanently disabled after she was struck by a Muni light-rail vehicle in
2013, officials agreed to award her an $11 million settlement.

The Chron reports that “Stoll’s lawsuit against the city alleged she was
crossing the street on a white walk signal and that the train operator ran
a red light,” but according to an April, 2015 settlement report from the
San Francisco City Attorney’s office to the SFMTA (I’ve uploaded the
entire document for you to read here the portions relevant to the Stoll
case begin on page 15. It’s really quite fascinating!) Stoll was wearing
earbuds and jaywalking when she was struck.

As noted in the city attorney’s settlement report, that same area has been
the site of three collisions to date, of which Stoll’s was the second. In
2011, 19-year-old Lauren Harrington was struck by an M that admittedly ran
a red light, leading to a $335,000 payout to Harrington from the city. In
2014, 20-year-old Leah Sarnoff was injured while standing in the passenger
area.

In their assessment, the city attorney’s office thought that SF might have
a chance at winning the case by arguing that Stoll was negligent after
all, they say, she had in earbuds and wasn’t watching where she was going.
But they also acknowledge that a jury might believe that the Muni
operator, Andre Richardson, was at fault.

According to the settlement report, the bill for Stoll’s treatment
immediately following the collision were $750,000, and her attorneys say
that her continued care is expected to run from $12,809,609-14,981,438. As
the city estimated that her continued care would be way cheaper between
$3 million to $4.5 million they factored in her lifetime of lost wages
and Stoll’s general damages, all to end up at the $11 million settlement
figure.

Sacramento, Calif. Travelers easily whiz from city to city on high-speed
trains in many parts of South America, Asia and Europe. Since the first
high-speed lines began operating more than 50 years ago in Japan, they
have become an essential part of transportation worldwide.

.

Yet the U.S. has never built a single mile of high-speed rail, which is
generally defined as accommodating trains that go at least 200 mph. And
proposals to do so have been thwarted for decades.

.

What’s holding America back?

.

For starters, a much larger land mass, longer distances between major
cities and the high cost of construction. Other factors include efficient
air travel, relatively low prices for gasoline and a car-based culture.

In an effort to jump-start high-speed rail, the Obama administration in
2009 awarded $7 billion for projects in California, Florida and Wisconsin.

Republican governors Rick Scott in Florida and Scott Walker in Wisconsin
rejected the funding and backed out of high-speed rail plans, sending more
of those dollars to California. Both governors said the cost to taxpayers
was far too high, and the potential for benefit far too risky. Walker
famously said he it would be faster and cheaper to drive his Saturn from
his Wauwatosa home to Madison than to drive downtown, pay for parking and
take a train.
