Donald Trump, Abortion Foe, Eyes Punishment for Women, Then Recants

Donald J. Trump said on Wednesday that women who seek abortions should be subject to some form of punishment if the procedure is banned in the United States, further elevating Republican concerns that his explosive remarks about women could doom the party in the fall.

.

The comment, which Mr. Trump later recanted, attracted instant, bipartisan criticism  the latest in a series of high-profile episodes that have shined a light on Mr. Trumps feeble approval ratings among women nationally.

.

In this case, Mr. Trump also ran afoul of conservative doctrine, with opponents of abortion rights immediately castigating him for suggesting that those who receive abortions  and not merely those who perform them should be punished if the practice is outlawed.

.

The statement came as Mr. Trump appeared at a town-hall-style forum with Chris Matthews of MSNBC, recorded for broadcast on Wednesday night. Mr. Matthews pressed Mr. Trump, who once supported abortion rights, on his calls to ban the procedure, asking how he might enforce such a restriction.

.

You go back to a position like they had where they would perhaps go to illegal places, Mr. Trump said, after initially deflecting questions. But you have to ban it.

.

He added, after a bit more prodding, There has to be some form of punishment.

.

Hours later, Mr. Trump recanted his remarks, essentially in full, a rare and remarkable shift for a candidate who proudly extols his unwillingness to apologize or bow to political correctness.

.

If abortion were disallowed, he said in a statement, the doctor or any other person performing this illegal act upon a woman would be held legally responsible, not the woman.

.

The woman is a victim in this case, as is the life in her womb, he continued.

.

Mr. Trumps Republican rivals moved quickly to distance themselves from his initial comments as well. Gov. John Kasich of Ohio said, Of course women shouldnt be punished.

.

I dont think thats an appropriate response, he told MSNBC. Its a difficult enough situation.

.

The campaign of Senator Ted Cruz of Texas said attention should be focused on providers of abortion, not the women who receive them.

.

Once again, Donald Trump has demonstrated that he hasnt seriously thought through the issues, and hell say anything just to get attention, Mr. Cruz said in a statement, adding, Of course we shouldnt be talking about punishing women; we should affirm their dignity and the incredible gift they have to bring life into the world.

.

For Republicans, the chaos felt something like a recurring nightmare. After the defeat of Mitt Romney in 2012, party leaders had hoped to move beyond a reputation for offensive comments on womens issues, emblematized by Todd Akin, a Senate candidate in Missouri who posited that victims of legitimate rape were somehow able to prevent pregnancy.

Apple vs. the FBI presents just such a trade-off. We can promote maximally secure information technology systems and pay some real costs in terms of how effective law enforcement can be. Or we can promote maximally efficient law enforcement and pay some real costs in the potential compromise to our information systems. Neither scenario offers the idealbut as Okun noted, when faced with irreconcilable values, the American system is designed to continually refine the balance.

Making trade-offs is crucial. The future wont be won by ideologues who speak in absolutes. Instead, we need reasonable people willing to honestly confront the downsides of every choice. Such complicated matters wont be settled by any individual court case or piece of legislation. Instead, the issues will be continually challenged and refined over time.

.

Despite the prevailing winner-take-all rhetoric, its possible to create meaningful legislation thats both modest and flexible. Rather than broad edicts about what must be accessible to law enforcement, Congress can set forth the factors that courts should consider when determining if a company should be compelled to provide a particular type of assistance and expressly limit what the government may request.

Apple’s legal standoff with the FBI ended Monday, but experts say the issues behind it will come up again, as more tech companies take measures to guard their customers’ messages, photos, business records and other files.

After weeks of heated debate, in which Apple had resisted the FBI’s demand for help, authorities say they found their own way to get the data from an encrypted iPhone used by one of the San Bernardino mass shooters.

.

WHAT WAS THE FIGHT ABOUT?

.

At the Justice Department’s request, a federal judge ordered Apple Inc.
last month to help the FBI unlock an encrypted iPhone used by Syed Farook,
who along with his wife, Tashfeen Malik, killed 14 people in December.
Specifically, the government wanted Apple to create software that would
override an “auto-wipe” feature which is designed to kick in after anyone
makes 10 wrong attempts at guessing the iPhone’s passcode. Once that
feature is activated, it renders all the data on the phone permanently
unreadable.

Apple said it could create the software the government wanted, but it argued vehemently that doing so would be a bad idea. CEO Tim Cook said the order would set a precedent for more government demands, both in the United States and around the world. Apple also said the software could be stolen by hackers and used against other iPhones.

.

Federal authorities insisted they were only asking for Apple’s help in a single case, although prosecutors nationwide have said they wanted similar assistance in other cases where iPhones have been seized. While it’s unclear if any useful information was stored on the iPhone, FBI Director James Comey said authorities owed it to the San Bernardino victims to leave no stone unturned in their investigation.

WHY DID THIS TURN INTO SUCH A BIG DEAL?

.

The case crystalized some long-simmering frustrations and conflict between the tech industry and law enforcement authorities.

.

Apple and other tech companies have been steadily increasing their use of encryption and other safeguards to protect their customers’ data, following a wave of recent hacking attacks and revelations about government data-collection by the former National Security Agency contractor Edward Snowden.

.

Law enforcement officials, including Comey, have complained that encryption and other data safeguards are helping dangerous people hide their activities, while interfering with the government’s ability to investigate crimes.

.

In the San Bernardino case, Apple drew support from other leading tech companies, computer security experts and civil liberties groups.

The Justice Departments efforts to force Apple AAPL +2.35% to help it hack into the iPhone that belonged to one of the San Bernardino shooters may be over, but if recent history is any indication, it wont be long before lawyers for the government are back in front of a judge with a similar request.

The American Civil Liberties Union today published details of 63 cases where the government has cited the All Writs Act to force Apple or Google GOOGL +1.67% to help it gain access to data contained on locked smartphones and tablets. The list includes cases involving drugs, identity theft and counterfeiting, among others. The disclosure comes one day after a judge threw out an order to compel Apple to help investigators in the San Bernardino case by writing software to disable a basic security function on the iPhone 5c. The order was vacated after lawyers for the Justice Department told the court Mondaythat they had what they needed from the phone and no longer needed Apples help.

We just thought transparency is so important, that we needed to see what these cases were, to see how the arguments evolved. It was unbelievable to us that this issue had been litigated  for the most part  outside of public view, said Matthew Segal, legal director of the ACLU of Massachusetts. For weeks, the group dug up any available information on cases using public databases, as the collective focus of privacy and security researchers, civil liberties groups, Silicon Valley and the media centered on the San Bernardino case.

Apple disclosed earlier this month a dozen other cases it was compelled to help with under the All Writs Act. Its unclear how many of those are included in the ACLUs list, since Apple did not release case names or docket numbers. Justice Department lawyers said previously that Apple had helped investigators unlock phones at least 70 times since 2008, prompting the ACLU to gather more information on the cases.

ACLU attorneys identified the cases by combing through court records with key words and phrases that appeared in previously identified filings. While no two requests made under the All Writs Act are exactly alike, Segal said there were enough similarities among them to come up with search terms to find others.

The ACLU also filed a Freedom of Information Act request with the Justice Department in December, seeking additional information on every case involving the All Writs Act. The Justice Department informed ACLU that they were gathering responsive documents, but as of today none have been produced, said Riana Pfefferkorn, a fellow at the Stanford Center for Internet and Society, which joined the ACLU in the request. Pfefferkorn said the San Bernardino case should be an indicator of the governments ability to hack into devices in other instances.

FLINT, MI — Using a portion of more than $100,000 in seed funding from the University of Michigan, experts will study the effects of the Flint water crisis, including the impact it has on youth perceptions and on population loss.

University of Michigan President Mark Schlissel announced in January that he would allocate $131,500 in donor gifts to get work started quickly. In all, seven projects were chosen for the funding.

Each project focuses on understanding ways the water crisis affected, and continues to affect, Flint and its residents. They’ll work to understand the medical, psycho-social, developmental and economic impact of the water crisis, according to a report from the university.

Research teams include experts from the School of Public Health, UM-Flint’s School of Health Professions and Studies, Wayne State University and Michigan State University’s College of Human Medicine.

Flint, Mich.  THE World Health Organizations action level for lead contamination in drinking water  indicating the need for intervention  is 10 parts per billion. The Environmental Protection Agencys action level is 15 parts per billion.

In tests of tap water in Flint., Mich., over the last six months, some 1,300 homes exceeded the E.P.A. action level. Thirty-two had levels above 1,000 parts per billion. And just this month, a sample showed a concentration as high as 11,846 parts per billion.

.

To understand the contamination of this city, think about drinking water through a straw coated in lead. As you sip, lead particles flake off into the water and are ingested. For almost two years, Flints children have been drinking water through lead-coated straws.

.

There are so many things wrong with this that its difficult to know what to address first. But since I called attention last year to an increase in children with elevated lead levels after the city changed its water supply, Ive known that my focus had to be on the kids. One of my patients, a 2-year-old girl, recently came to the clinic for her checkup. Running around the room with her colorful gown flapping, she hopped onto the exam table, grabbed my stethoscope and placed it on her chest. I gently nudged it over her heart. Can you hear anything? Her eyes lit up, and she nodded.

Her mother turned to me, trying to hide her tears. She thought the water was safe, and why not? The authorities told her it was. She mixed her daughters baby formula with warm tap water. She got a filter only when the National Guard came to her door this year. Now she wonders, will her daughter be O.K.?

.

The same question can be asked about the more than 8,000 other children here under the age of 6 who drank lead-contaminated water.

.

Numerous epidemiologic studies of lead exposure in children, particularly those under the age of 6, indicate an increased risk for damage to cognition, behavior and employment prospects, also lower I.Q.s, poor impulse control and decreased lifetime earnings. Epigenetic research suggests that lead exposure in women can lead to DNA changes in their grandchildren. Their grandchildren.

And yet my little patient may be all right. Not every child exposed to lead will suffer the most severe consequences. Some will be fine, though the Centers for Disease Control and Prevention warns that there is no safe level of lead in a child.
