for Charities That Solicit Money

Donald Trumps charitable foundation  which has been sustained for years by donors outside the Trump family  has never obtained the certification that New York requires before charities can solicit money from the public, according to the state attorney generals office.

Under the laws in New York, where the Donald J. Trump Foundation is based, any charity that solicits more than $25,000 a year from the public must obtain a special kind of registration beforehand. Charities as large as Trumps must also submit to a rigorous annual audit that asks  among other things  whether the charity spent any money for the personal benefit of its officers.

If New York Attorney General Eric Schneiderman (D) finds that Trumps foundation raised money in violation of the law, he could order the charity to stop raising money immediately. With a courts permission, Schneiderman could also force Trump to return money that his foundation has already raised.

Schneidermans office declined to comment on whether it was investigating the lack of registration for the Trump Foundation. Schneiderman had previously launched an investigation of the foundation in the wake of reports by The Washington Post that Trump used his charitys money to make a political gift, to buy paintings of himself and to settle legal disputes involving his for-profit businesses.

Tax filings show that in each of the past 10 years for which there are records, the Trump Foundation raised more than $25,000 from outsiders. Tax records alone do not reveal whether the donations amounted to solicitations under New York law, but in several cases there is strong evidence that they did.

.

For instance, the foundation has received more than $2.3 million from companies that owed money to Trump or one of his businesses  but that were instructed to pay the foundation instead, according to people familiar with those transactions.

.

In the most obvious example of a public solicitation, the Trump Foundation set up a website early this year to collect small-dollar donations that it promised to pass along to veterans. In all, the website said, the Trump Foundation took in $1.67 million through that site.

But, as of this week, the Trump Foundation had not obtained the state registration required to ask for donations, according to a spokesman for Schneiderman.

.

Experts on charity law said they were surprised that Trumps foundation given its connections to a wealthy man and his complex corporation  did not register to solicit funds.

Hes a billionaire who acts like a thousandaire, said James J. Fishman, a professor at Pace Universitys law school in White Plains, N.Y. He said Trumps foundation seemed to have made errors, including the lack of proper registration, that were more common among very small family foundations.

In 2005, Trumps wife, Melania, was named Godmother of a new ship launched by Norwegian Cruise Lines. As part of its agreement with Melania Trump, the cruise lines said, it gave $100,000 to the Trump Foundation.

In the meantime, Trump himself drastically reduced his gifts. After 2008, tax records show he stopped giving altogether. Since then, according to tax records, the Trump Foundation has received all of its incoming money more than $4.3 million  from other donors.

Under state law, charities that solicit donations from others in New York must register under a different law, called 7A for its article heading.

Then, this year, Trump skipped a Republican primary debate in Iowa and instead held a televised fundraiser for veterans causes. As part of that effort, he set up a website, donaldtrumpforvets.com, which took donations via credit card  and sent them to the Donald J. Trump Foundation.

Over 1,670,000 raised online, said the thank-you message from the Trump Foundation, after The Post made a $10 donation in March.

The most important consequence of not registering under the more rigorous 7A level was that the Trump Foundation was not required by the state to submit to an annual audit by outside accountants. In such an audit, charity-law experts said, the accountants might have checked the Trump Foundations books  comparing its records with its outgoing checks, and asking whether the foundation had engaged in any transactions that benefited Trump or his businesses.

In recent years, The Post has reported, Trumps foundation does appear to have violated tax laws in several instances.

In 2013, it gave a donation to a political group supporting Florida Attorney General Pam Bondi (R)  despite a ban on nonprofit groups making political gifts. The Trump Foundation then filed an incorrect tax filing, which omitted any mention of that gift, and said incorrectly that the money had gone to a charity in Kansas. Trump paid a $2,500 penalty tax for that political gift this year.

A New Jersey Transit commuter train crashed into Hoboken Terminal during rush hour Thursday morning, killing one person and injuring more than 100 at one of the busiest transportation hubs in the Northeast.

New Jersey Gov. Chris Christie (R) said 114 people were hurt, including the trains operator, who was critically injured. He said the engineer was cooperating with the investigation.

.

This train came at a high rate of speed into the station and crashed through all the barriers, bringing it all the way to the internal wall of the Hoboken terminal, Christie said. He added that officials would not speculate on the cause of the crash. We have no indication that this was anything but a tragic accident.

.

Accountant Jim Finan was sitting toward the rear of the first car when he realized the train was coming in much too fast.

.

We were getting to the platform, but we were still at full speed, Finan, 42, said. The train didnt slow down at allThe only thing that stopped the train is the fact that it slammed into the building.

.

The scene was horrendous. People were bleeding profusely from cuts to their head, he said, and one man seemed to be holding his severed thumb in place. Others had cuts on their hands. Finan pulled off the rubber around an emergency-exit window and another man pushed the window out. They both helped two women crawl out of the train before NJ Transit workers began opening the doors.

.

Christie lauded the resilience of northeast residents, who have weathered a succession of natural disasters and rail accidents in recent years and, most recently, a bombing in Manhattans Chelsea neighborhood that injured 31.

.

Regular commuters left the safety of where they were standing, to rush to the train, to help first responders evacuate injured people off the train, Christie said of the Hoboken crash. This region has developed a resilience that is admired by the rest of the world because of the way weve been tested.

.

New York Gov. Andrew Cuomo described the devastation at the afternoon news conference.

.

When you see the destruction up close, the silver lining is that theres only been one fatality so far, Cuomo said. Because the destruction is significant. And the power of train coming in is obviously devastating in its impact.

.

The New Jersey State Medical Examiner identified the crash victim as Fabiola Bittar de Kroon, 34, of Hoboken. Christie said she was killed by debris created by the crash.

.

I pray the number doesnt go up, said state Assemblyman Raj Mukherji (D), who represents Hoboken. Were just praying for those affected. And were praying that the death toll doesnt increase.

The crash, Christie said, appeared to be accidental in nature.

.

At about 8:45 a.m., a Pascack Valley Line train, which was traveling from Spring Valley, N.Y., crashed into Hoboken Terminal, according to New Jersey Transit.
.

Most of the people injured in the crash were in the first car or standing on the platform; passengers in the other cars were better able to escape, according to WABC.

.

New Jersey Transit said some passengers were trapped under the debris, though Christie said late Thursday morning that all of those people had been removed and transported to hospitals.

EL CAJON, CALIF. The fatal police shooting of a Ugandan refugee who drew something from his pocket and extended his hands in a shooting stance happened about a minute after officers in a San Diego suburb arrived at the scene where a mentally unstable man was reportedly walking in traffic, a police spokesman said Wednesday.

The victim was identified as Alfred Olango, according to CBS affiliate KFMB.

.

Mayor Bill Wells said he was concerned about the short time from the officers arrival to the shooting, though he said video taken by a bystander was enlightening and he didnt think it was tremendously complicated to figure out what happened.

Wells was asked how he would feel if it was his child that had been shot.

I saw a man who was distraught, and a man acting like he was in great pain, Wells said. And I saw him get gunned down and killed. If he was my son, I would be devastated.

.

The single photo is all police released depicting the incident that sparked angry protests by demonstrators demanding more information and wanting to know how police could shoot an unarmed man.

Crowds gathered at El Cajon Police Department headquarters Wednesday for a second round of protests, CBS affiliate KFMB reported.

.

Candles and flowers were left Wednesday at the shooting scene, near bloodstains on the pavement.

.

Dozens protested outside the police station Wednesday, holding signs that read No Killer Cops! and chanting no justice, no peace, and black lives matter.

.

The fatal shooting happened less than two weeks after black men were shot and killed by police in Tulsa, Oklahoma, and Charlotte, North Carolina, where violent protests broke out.

.

El Cajon Police Department released a statement Wednesday night?. In the statement the department said the man was not acting like himself.

.

While detectives where on scene investigating the officer involved shooting, a witness came forward and notified officers they had video footage of the incident, the statement read.

Police have not named the officers involved, though Wells said both were 21-year veterans and one was Officer Richard Gonsalves. Wells didnt say if Gonsalves was the officer who fired the gun or Taser.

Christopher Rice-Wilson, associate director of the civil rights group Alliance San Diego, questioned why one officer felt non-lethal force was appropriate while the other did not. Both officers have been put on administrative leave while the incident is investigated, per department policy.

Just moments after an African American man was shot and killed by El Cajon police Tuesday, his sister was captured in an eyewitness video as she wept and screamed at officers, saying she told authorities her brother was mentally ill.

.

In the video posted on YouTube (some explicit language), the mans sister said she told officers he was sick and needed help. She said she called police three times but instead should have called a crisis communication team.

.

Dont you guys have a crisis communication team to talk to somebody mentally sick? she asked an officer.

.

Why couldnt you tase him? she asked officers. Why, why, why, why?

.

Amid outrage and protests over the death of the man  identified as Alfred Okwera Olango  El Cajons mayor vowed a full investigation and said the FBI has joined the probe of the incident.

.

The most important thing to take away from this meeting today is a tragedy occurred In El Cajon yesterday. We lost a life. Nobody wants to see the loss of a life, Mayor Bill Wells said at a Wednesdayafternoon press conference.  The family is devastated. The person who lost his life is devastated. Even the police officers involved in the shooting are devastated, and certainly the community is devastated.

Wells also spoke of the death in personal terms. I saw  a man who was distraught, a man who was acting out like he was in great pain. I saw him get gunned down and killed. If it was my son, I would be devastated.

Most of the demonstrators voiced concerns that the shooting was racially motivated.

.

By 1 p.m. Wednesday, a crowd of roughly 100 demonstrators had marched from the police station to the scene of the shooting several blocks away, as a cordon of roughly 25 San Diego County Sheriffs deputies stood nearby. The deputies wore riot helmets and held long wooden batons at port arms.

.

During the march, protesters momentarily blocked traffic at the intersection of Magnolia and Main streets downtown. As car horns honked, either in protest or frustration, the demonstrators chanted black lives matter and thrust their fists in the air.

.

Their foreheads dripping sweat under an unrelenting sun, activists held signs that read “release the 911 call” and No justice, no peace!  a rallying cry heard at similar protests throughout the nation.

A 14-year-old boy shot a teacher and two young pupils, one of whom was critically wounded, at a South Carolina elementary school Wednesday, and his father was later found dead by the suspect’s grandmother at a home nearby, authorities said.

One of the injured boys, identified as Jacob Hall, was listed in critical condition Wednesday night at Greenville Health System Children’s Hospital in Anderson County. No further details, including Jacob’s age, were provided. The teacher, a woman who wasn’t identified, and the other boy were treated and released from a hospital.

The suspect, who officials said was home-schooled, was taken into custody without incident on the grounds of Townville Elementary School at 1:45 p.m. by a 30-year veteran of the Townville Volunteer Fire Department, authorities said.

The 14-year-old boy drove up to the school, which is in Townville about 35 miles southwest of Greenville, and immediately began firing shots with a handgun, Anderson County Sheriff John Skipper said. He shot all of his victims on the playground and wasn’t able to enter the school itself because teachers made sure to lock the doors, officials said.

Almost simultaneously, investigators were called to a home about 3 miles away, where the body of Jeffrey Dewitt Osborne, 47, the suspect’s father, had been discovered by Osborne’s mother, who lives next door, authorities said Wednesday night.

Osborne’s mother got a cellphone call from her grandson  the suspect  but “she could not make out what he was saying because he was crying and upset,” Anderson County Coroner Greg Shore said. She went next door to the boy’s home, where she believed him to have been calling from, and found Osborne, who had been shot to death, Shore said.

Authorities didn’t say whether Osborne was shot by his son, adding that the “relevance” of Osborne’s death remained under investigation. Any relationship between the shooter and the victims at the school remained unclear, authorities said.

A police officer in the Californian city of San Diego shot and killed a mentally ill black man who was unarmed after his sister called authorities for assistance when he began acting strangely.

Police from the El Cajon suburb released a statement late on Tuesday night, several hours after the shooting outside the Broadway Village shopping centre, confirming the man died in a hospital. His family identified him as 30-year-old Alfred Olango.

.

Police were called by Olango’s sister who said he was acting strangely and not himself. The aftermath of the fatal shooting was filmed by a bystander who  posted the clip on Facebook. That video has been viewed about 40,000 times.

.

“Why couldn’t you tase him? I told you he is sick – and you guys shot him!” Olango’s sister can be heard telling officers in the video. “I called police to help him, not to kill him.”

.

Jeff Davis, the  El Cajon police chief, said the man was not armed, adding Olango ignored calls to remove his hands from his pockets and pulled out an object.

Davis said one officer used a stun-gun against him while another fired his weapon because they felt threatened.

.

“At one point, the subject rapidly drew an object from his front pants pocket, placed both hands together and extended them rapidly toward the officer taking up what appeared to be a shooting stance,” Davis said in a statement.

.

“At this time, the officer with the electronic control device discharged his weapon. Simultaneously the officer with the firearm discharged his weapon several times, striking the subject.”

.

Witnesses said they heard five shots as police confronted Olango.

.

Davis said the two officers involved in the shooting, each with more than 20 years of service, had been placed on administrative leave pending the investigation.

Local news agency CBS8 reported that “several witnesses alleged that the officers were unduly quick to open fire and suggested that their actions had been influenced by the fact that they were dealing with a black man, one they described as mentally challenged”.

.

“One man angrily told reporters at the news conference that the victim was suffering a seizure prior to the shooting, and another described seeing him with his hands raised at the moment the shots sounded,” CBS8 said.

The shooting spurred protests at the scene for several hours, alleging police racism. Demonstrations were also later held outside the police department.
